More likely it is a ham radio rig, but if it is CB then he is probably outside the wattage limits. I think to prove anything you are going have to contact a ham with scanning gear and find out what frequencies and power he is using and what the content is. Then you decide whether to talk to him and threaten to go to the FCC or just send a detailed complaint to the FCC.
